For today’s Race of the Day – I’m excited to have the opportunity to shed light on one of the marquee races of this cycle – Allen West vs. Ron Klein in Florida’s 22nd Congressional District.

Florida’s 22nd Congressional District stretches along the coastline from the upper portion of Broward County in the south to Palm Beach County in the north. The district was represented for seven terms by Republican Clay Shaw from 1992 until Democrat Ron Klein won the seat in the Democrat wave year of 2006 by a 51%-48% margin. It was also Ground Zero for the 2000 Presidential election drama between Democratic nominee Al Gore and eventual winner George W. Bush on the Republican side. President Obama won the district by a 52%-48% margin and it is scored as a D+1 on the Cook Partisan Voting Index, underscoring the tossup nature of the seat.

Prior to his election in this swing district in South Florida in 2006, Ron Klein previously served as a state senator. But instead of representing his constituents, he’s marched in lockstep with Speaker Pelosi from Day One, voting with her 98.1% of the time.

n 1995 and 1996, future Supreme Court nominee Elena Kagan was involved in a bizarre controversy in which the Clinton White House was accused of siding with an eco-terrorist group locked in a standoff with federal agents deep in the woods of Oregon. The incident led to an investigation by House Republicans, who concluded that a staffer on the White House Council on Environmental Quality tipped off the environmental radicals to impending action by U.S. Forest Service law enforcement agents — a leak that Forest Service officials believed endangered the lives of their agents on the ground.

Kagan, at the time an associate White House counsel, had no role in leaking the feds’ plans to the radicals, but House Committee on Natural Resources investigators concluded she shirked her responsibility by not searching for the source of the leak or pushing for punishment of the leaker.

“Nothing was ever done by Elena Kagan to learn the details about the leaks, or to identify the leaker and ensure that proper punishment occurred,” the committee’s 1999 report concluded. In fact, investigators found evidence suggesting that Kagan, in internal White House discussions, defended the alleged leaker.

Ok, look. I know there are a lot of you who are pissed that Glenn Beck has repudiated the “birther” question. I’m not crazy about it either. But as another “hold-their-feet-to-the-fire” media firebreather Andrew Breitbart put it during an argument with Joseph Farah of World Net Daily, the “birther” eligibility issue is not a winnable argument. At least not YET.

If and when we retake the majority in Congress, Americans might have a shot at unveiling and unraveling the background and official records of “AKA” — the ONE believed to be a usurper in the White House. Nevertheless, you have to admit that even without the birth records ad infinitum, the REAL Barack Obama is being revealed. So… having said that, this post is for all of you who believe the tripe put out there by the Left and/or the uninformed, that Beck’s ratings have fallen off as a result. NOT true. I did a check on it and here’s the latest from Nielsen:

Now that President Obama has announced his choice for the soon to be vacant Supreme Court seat we are learning that Elena Kagan is as close to a “manufactured candidate” as possible without a degree in robotics.

As the investigation of Elena Kagan builds momentum, the early picture is of an academic ideologue whose path was carefully directed to this very point in time. Ironically, the information on her history is far more clear and verifiable than the man who nominated her for the highest court in the land.

Booted and operational it was time for field-testing. Phase one she clerks for Judge Abner Mikva at the U.S. Court of Appeals for the D.C. Circuit. A “mail-room entry” where integration can be fine-tuned and if need be, pulled for larger corrections without many ripples. Phase two, she enters the inner sanctum and performs the reconnaissance role serving as law clerk to Supreme Court Justice Thurgood Marshall. This completes her field-testing and there is nary a suspicion that she has just made a trial run at her ultimate target.

A proposal to grant medals for “courageous restraint” to troops in Afghanistan who avoid deadly force at a risk to themselves has generated concern among U.S. soldiers and experts who worry it could embolden enemy fighters and confuse friendly forces.

Lt. Col. Edward Sholtis, a spokesman for Gen. Stanley A. McChrystal, who commands NATO forces in Afghanistan, said that no final decision has been made on the award, which is the brainchild of British Maj. Gen. Nick Carter.

“The idea is being reviewed at Headquarters ISAF,” Sholtis said. “The idea is consistent with our approach. Our young men and women display remarkable courage every day, including situations where they refrain from using lethal force, even at risk to themselves, in order to prevent possible harm to civilians. … That restraint is an act of discipline and courage not much different than those seen in combat actions.”

House Minority Leader John Boehner says there’s a “political rebellion” brewing in America that is touching both Democratic and Republican incumbents.

Boehner offered a stern assessment of the political environment after meeting with his party behind closed doors Wednesday, saying “it’s politicians beware.”

“[Utah Republican] Senator [Robert] Bennett found out on Saturday, [West Virginia Democratic] Rep. [Alan] Mollohan found out on Tuesday night,” Boehner said.

Mollohan, a 28-year incumbent, was trounced in the Democratic primary by 12 points Tuesday night, and Bennett, an 18-year Senate veteran, was ousted at a weekend convention of the Utah Republican Party.

“The American people are awake,” Boehner said. “They’re more involved in their government than at any time in our history and what irritates the American people most is the arrogance of Washington.”

It’s a good time for a reemergence of conservatism. Liberalism has discredited itself by trying to govern and passing hugely unpopular legislation, and the opportunity for the right to strike back is coming this November.

Thus conservatives are looking for someone who can lead us to victory and small government, and one candidate in particular has emerged, winning the CPAC straw poll in November and falling just one vote short of winning the Southern Republican Leadership Conference straw poll last month.

Of course, I’m talking about Ron Paul.

Yeah. Him again. Just when we thought it was safe to once again have an inconsequential poll, here come the Ronulans to try and snatch up a pointless victory. Yeah, okay guys — all the online polls and text polls Paul won back in 2008 didn’t convince me Ron Paul had any actual support, but now I think it’s for real. That was sarcasm, by the way (I don’t think a lot of Ron Paul’s supporters understand sarcasm), but sarcasm aside, I argue that if we’re smart, we’ll invest the future of the GOP in Ron Paul.

So who is Ron Paul? I don’t really know. I think he’s like a representative from Texas or something who thinks gold is shiny and wants to follow the principles of George Jefferson. The point isn’t who he is, though; it’s that he’s catnip for crazies.

President Obama plans to force the oil industry to pay for the spill in the Gulf of Mexico by introducing a hike in tax rates and increasing the liability for clean-up costs.

The White House sent an unusually detailed proposal to Congress today that included a blanket 25 per cent tax increase on every barrel of oil produced. The legislation would allow the federal Government to demand more money from companies responsible for environmental disasters.

Mr Obama has been deeply frustrated by the failure to plug a ruptured pipe near the coast of Louisiana as it spews an estimated 25,000 gallons of oil every day. If passed his proposals could leave BP with a bill running to $10 billion (£6.8 billion).

Paul Campos is a professor of law at the University of Colorado at Boulder. In his article The Next Harriet Miers? He absolutely slays the phony Liberal narrative that Elena Kagan is a brilliant legal scholar who makes up for a lack of jurist experience with unsurpassed legal scholarship.

Therefore according to linear Liberal logic Kagan is worthy of being nominated and confirmed for the Supreme Court only because president Soetoro says so. Not because of any deserving scholarly works or experience. This is starting to sound strangely familiar to the president’s own eligibility problems.

According to Professor Campos there is no there there in Kagan’s legal academic scholarship. Campos recounts a career of nearly 20 years since Kagan became a law professor in which Kagan’s academic writings are so scant he was able to read everything that Kagan had ever published in one day. In his latest series on “Secession or Declaration of Independence”, particularly Parts 4 and 5, Mr. Timothy Baldwin raises some interesting points.

Unfortunately, he misconstrues my meaning when he attributes to me the notion that (in his words) “as long as the [General G]overnment is executing laws, regulations, restriction, mandates, etc., ‘in the name of doing good’, then such a regime and such acts are not tyrannous regardless of effect”. I thought I had made it clear enough in my commentaries on this subject that, if public officials were actually trying to obey the Constitution (not just going through the motions “in the name of doing good”), their actions would not constitute “tyranny” even if the effects thereof inadvertently might not satisfy with mathematical precision some hyper-technical definition of “the common defence” and “the general Welfare”. This is because there must always be some “play in the gears” for any government to function. Mr. Baldwin, however, seems to contend that any such “play” amounts, at least presumptively, to “tyranny”.

Presumptively may not be the half of it, either. For example, Congress may decide to build a naval base in Norfolk, Virginia, rather than in Savannah, Georgia. If Congress does this in good faith, for sufficient reasons, is it to be condemned because the construction and operation of a base in Norfolk will stimulate the local economy there, but do nothing for Savannah in that regard? Has Congress violated “the general Welfare”, and thereby engaged in “tyranny”, by not building a base in Savannah, too, even though “the common defence” did not require it? According to Mr. Baldwin’s test, perhaps so, because the inevitable “effect” of Congress’s action would be to create economic discrimination between the two cities deriving directly from the location of the base. But every such decision will have such an effect, more or less. To avoid a charge of “tyranny” with respect to “the general Welfare”, then, must Congress build half of the base in Norfolk and half in Savannah, so that each city will share equally in the economic benefits? Yet, if it did so, would Congress not undermine “the common defense” by making neither demi-base sufficient for the Navy’s needs—thereby exposing itself to a charge of “tyranny” with respect to “the common defense”? In situations of this kind, then, are “the general Welfare” and “the common defence” mutually contradictory and antagonistic? Will Congress be committing “tyranny” no matter what it does? Is the Constitution psychotic? Well, if such is the consequence of Mr. Baldwin’s theory, perhaps that theory is overly broad.

Along the same lines, Mr. Baldwin later contends that “[w]here the law does not grant to the government the power to do an act, then the government’s doing that act in contradiction of the law is tyranny”. Again, he overstates the matter. Consider, for example, the following case. The Constitution requires that “[n]o Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law”. Article I, § 9, cl. 7. Assume that Congress has appropriated “by Law” $1,375,276.00 for some public construction project, to be paid over to a private contractor. By mistake, a clerk causes an electronic check to be drawn on the Treasury for $1,735,276.00 and deposited directly into the contractor’s account. Without noticing the error, the contractor’s accountants start paying the contractor’s employees and suppliers on that project with funds from that account. During the period before the error is discovered and corrected, has the General Government (or the Treasury, or perhaps the clerk) been engaged in “tyranny”? After all, the payment was in excess of the “Appropriation[ ] made by Law”, and therefore was “in contradiction of the law”. And Mr. Baldwin contends that any act of the government (which always entails an act of some public official or employee) “in contradiction of the law is tyranny”. If, however, the posited situation does not entail “tyranny” (as common sense suggests it does not), then Mr. Baldwin’s definition must be flawed.

The evident flaw is Mr. Baldwin’s notion that the intent of the actor is irrelevant to whether his misbehavior can properly be characterized as “tyranny” or not. Now, I believe every violation of a public official’s “Oath or Affirmation, to support th[e] Constitution” (as required by Article VI, cl. 3) should be punishable in some manner. That does not mean, however, that every such violation constitutes “tyranny” and deserves the very same punishment. Consider two cases:

[1] Congress is trying to decide whether to build a new naval base in Norfolk, Virginia, or Savannah, Georgia. The Congressmen in the committee to which the bill is assigned take a light and careless approach to their duties. They fail to study the matter sufficiently. As a result, the committee recommends Savannah, when it should have recommended Norfolk. Based upon that faulty recommendation, the bill passes. Several years later, the mistake is discovered, but by then cannot easily or inexpensively be rectified—meaning that “the common defense” has been compromised. Can this situation, as serious as it may be, be fairly described at any stage as the embodiment or the consequence of “tyranny”? Not, I suggest, without seriously trivializing that word.

Many have come to the conclusion that Secession by those States that desire to throw off the ties of tyranny is necessary–more so now than ever before in America’s history. I would place myself into this category. There are many in the United States who argue with this conclusion, either on the basis of practicality or right.

As to the question of practicality, its analogy is like a husband and wife asking the question, “can we now afford to have children?” The answer most always is “no.” Having children is always a sacrifice and inconvenience. Of course no one prefers inconvenience, but such a price should be willingly paid where freedom is obtained. Thus, at some point, a State must act upon the freedom to be gained at the cost of the sacrifice to be initially made.

As to the basis of right, most do so based upon a scheme of creative constructions and implicit arguments of the U.S. Constitution or based upon the results of the Civil War.

While I can, to some degree, “stomach” those who argue that the U.S. Constitution prohibits secession, I am repulsed by those who argue that the results of the Civil War “settled the issue” of secession. I do not desire at this time to get into the fatal error of this position and implied philosophy, but I will state conclusively that if one really believes this, then he or she has to accept the logical conclusion that:

- this union is held together by force alone and not by the consent of the governed, thus making us all slaves to the union;
- the Confederate States of America were States controlled and occupied by an enemy conqueror, and still are today;
- the U.S. Constitution has nothing to do with the legitimacy or rightfulness of the union’s forceful existence; and
- “might makes right.”

I find those positions to be dangerous to liberty, freedom and rights and do not see how holders of such positions can adhere to any principles resulting in freedom as expressed by the Declaration of Independence.

However, for the student of truth and freedom, coming to the conclusion of Secession’s right and necessity obtains from the study of nature and the principles and laws derived therefrom, just as America’s founding fathers did in 1776 by their expression in the Declaration of Independence.

As I wrote about in my previous articles, Secession or Declaration of Independence, Parts 1-5, people have a certain immutable nature which leads them to form society for certain beneficial purposes. These people will lay down a certain part of their natural rights to receive the benefits of that society. As a result, that society inevitably forms government to protect their natural rights from others in society so that each may live in peace and for the purposes they entered the society.

This is just plain nuts. Lt. Col. Terry Lakin, a highly-decorated Army surgeon, with 18-years of service behind him, is willingly throwing his career and reputation away, because be believes in the birther conspiracy nonsense that President Obama is not a natural born citizen. The Army has instituted court martial proceedings against him for refusing to obey deployment orders to Afghanistan, which Lakin says are illegal orders from an illegal alien. The birther doctor appeared on CNN’s Anderson Cooper’s 360 program Friday evening with his lawyer. And the interview soon turn heated, as Cooper attempted to inject some fact-based reality into the conversation.

Lakin’s lawyer Paul Jensen, obtained by the birther conspiracy groups American Patriot Foundation/Safeguard Our Constitution, continually jumped in to answer Cooper’s questions posed to Lakin. The basis of Jensen’s arguments all center on his rejection of Obama’s Certificate of Live birth issued by the state of Hawaii. He contends it’s not proof of Obama’s birth in the United States, because it’s merely an “abstract” of the original document on file. Lakin through his lawyer, is demanding to see the original document.

Jensen couldn’t explain Obama’s two birth notices in local Hawaii newspapers. And he refuses to accept the determination made by the Republican governor of Hawaii, who examined the original birth certificate on file, declaring it valid.

Flash back to the end of March, when the authorities hauled in nine members of the Hutaree, a Christian paramilitary group, and charged them with plotting a mass assassination of police officers. The media quickly added the arrests to the ongoing narrative of “rising right-wing violence,” with the Michigan-based militants cast as the leading edge of a smoldering paramilitary threat. Newscasters and columnists touted a report by the Southern Poverty Law Center (SPLC) claiming that the number of anti-government “Patriot” organizations is skyrocketing. An “astonishing 363 new Patriot groups appeared in 2009,” the center declared, “with the totals going from 149 groups (including 42 militias) to 512 (127 of them militias)—a 244% jump.” If you worry about political violence, the SPLC warned, such growth “is cause for grave concern.”

A month later, the Hutaree case is in a state of flux, with prosecutors appealing Judge Victoria Roberts’ ruling that the accused should be released on bond while awaiting their trial. There are signs that the judge is unimpressed with the state’s case, and she has stressed that prosecutors must demonstrate that the arrestees were guilty of an actual conspiracy to kill cops, not just loose talk. Even “hate-filled, venomous speech,” she said, is “a right that deserves First Amendment protection.”

Obviously we don’t know what evidence has yet to be introduced at trial. Perhaps there really is more at issue here than some chest-beating chatter; perhaps there’s a good reason to think a genuine murder plot was underway. But either way, we’ve learned enough about the Hutaree in the last month to know that the media narrative that greeted their arrests hasn’t held up. Assume the worst-case scenario: that the defendants really were planning a massacre and that they really were capable of carrying it out. They still aren’t the vanguard of the right-wing revolution. The Hutaree are isolated and despised, not just by the American mainstream but by the bulk of the groups on the SPLC’s Patriot list. Indeed, the government may have had the help of some anti-Hutaree militiamen as it forged its case against the accused.
