The cancer of environmental justice, social justice, transportation justice (every justice but equal justice) are metasticizing throughout the body politic. The USDA has put out a document for public comment on it’s

Environmental Justice Strategic Plan. Page 14 of the draft specifies that the purpose is to help minority and/or low income populations including American Indian or Alaskan Native populations. It’s time to put an end to all these “special classes” of people. We are all Americans. Let’s not let our government put us in categories and play us off against each other.

There are 6 major goals outlined in the plan. I have focused below on two of them with some of their agency specific programs

1. Environmental Justice runs counter to the precepts of the US Constitution which is the ultimate law of the land. The United States was founded on EQUAL justice. This document perverts the equal justice provisions of the law by granting special priviledges to minorities and low income people.

2. The document is based on Executive Order 12898. An Executive Order is also subservient to the Constitution and should be disregarded.

3. USDA has settled the Pigford case based on these types of policies costing the US taxpayers billions of dollars in bogus claims of wrongly denied agricultural loans. Your policies have NOT been beneficial to any communities except a few select groups. This is a travesty that is being perpetrated on the taxpayer.

Democrats are resorting to desperate measures to try to insure a 2012 victory for Barak Obama and I believe the expression ‘by hook or by crook’ best describes their methods.

Like many of you, I love to go fishing. I’ve fished many different ways for a number of different types of fish, but always with the same objective, to hook them and reel them in. I have used various baits from worms, to corn to dough balls and chicken liver to fish with a bobber. I’ve bass fished using a variety of different lures with the best results being lures my dad made. Most of all, I enjoy fly fishing as there is more finesse involved in landing your catch.

And all of this reminds me of politics and the use of some kind of bait to lure in the voter. Once the voter takes the bait by casting their vote, they’re stuck with the consequences and in the case of the Democrats of late, those consequences are much like caught fish, because you end up being devoured by the one that caught you.

RUSH: All right, some people in the e-mail have taken exception with my description of Obama as “lawless” and acting outside the Constitution. Let me share with you a quote, and this is from a video. It might have been from yesterday out in Ohio, but it’s within the past couple days. Obama said, “When Congress refuses to act — and as a result, hurts our economy and puts our people at risk — then I have an obligation as president to do what I can without them.” He got applause. “I have an obligation to act on behalf of the American people. I’m not going to stand by while a minority in the Senate puts party ideology ahead of the people that we elected to serve. Not with so much at stake, not at this make-or-break moment for middle class Americans. We’re not gonna let that happen.”

Now, the Founding Fathers said this is exactly what’s supposed to happen! It’s called “the separation of powers,” and it’s to make sure that things like this do not happen, that an all-powerful executive does not run roughshod over the government. But President Obama has just said: Because the Congress we want to do what I want them to do I’m gonna do it myself. That is extraconstitutional! That is not the way this government was set up. It was not the idea of the Founders. That’s acting outside the Constitution, and there’s no question about it — and the Obama campaign is claiming he’s doing all these recess appointments and things like this “to help the economy.” Reuters again: “Hammering populist themes that show him to be a champion of the middle class, aides say the president will keep taking steps to show voters he’ll make moves on his own to help the economy if Congress refuses to act.”

If Congress “refuses to act,” it is his job to sit down and talk to ‘em and make ‘em act and get them to vote the way he wants. He does not have — unless they grant it to him (and they’re doing it, by the way) — the authority to run roughshod over them. But if they don’t stop him, he can do it. We can’t. Congress has to stand up for itself. Now, the Democrats run the Senate. I think they’re happy for this to happen. Dingy Harry loves for this to happen because they’re sitting there blaming it on the House Republicans who have no role in this. It’s an election year, so blame the Republicans for it. Folks, it is clearly lawless. If you regard the Constitution as law, this is lawless behavior by an out-of-control, rogue executive. This is what happens in banana republics, tinhorn dictatorships. In places like Venezuela, this is what happens — all under the guise of populism and helping the middle class.

Nicholas Lemann of the New Yorker wrote a particular ill-manned, nasty and ignorant dismissal of Ron Paul and his campaign for the Presidency of the U.S. (It is dated 1/9/12, but I first saw it this evening, on 1/3/12). I shall subject his vicious screed to a line by line, well, more often, paragraph by paragraph, criticism.

Why should I spend so much time on such unimportant drivel as this, written by an author of no particular distinction? I’m not sure. It is by far not the worst of the smears about Congressman Paul. There are more objectionable pieces out there, far worse ones. Maybe it is because I am originally from New York City, and I used to regularly read the New Yorker. Maybe it is because, as I write, the returns are coming in from Iowa, and I don’t have the capacity to pen anything original; it is far easier to react to an author than to blaze a new path. And, I just can’t sit here, eyes glued to the results, as they slowly come in. (Wait a minute. I’ve got to go and check how Ron is doing.

Shah Gilani writes: Rampant profiteering by Congress and greedy bankers is forcing us to weigh the slings and arrows of outrageous fortune against honesty and transparency – both of which are being trampled by crony capitalists in pursuit of the almighty dollar.

What’s at stake is whether gross criminal activity and reckless disregard for the public will continue to be whitewashed by regulators like the Securities and Exchange Commission (SEC), the U.S. Federal Reserve, courts, and Congress, which encourage half-baked civil fraud charges followed by non-prosecution agreements and nickel-and-dime fines.

And even more galling, guilty parties end up neither admitting nor denying wrongdoing.

Let’s face it, we have allowed the SEC, the Fed, and Congress to be corralled as a matter of regulatory and legislative capture by the very crooks they are responsible for policing and protecting us from.

We are lying to ourselves if we do not believe that we are all part of this problem. It’s not that most of us aren’t honest. It’s that we venerate money and wealth too much.

Rather than being disgusted by dishonest manipulators, liars and cheats, we excuse the less-than-obvious perpetrators as if their example of cutting corners to get ahead, as far ahead as possible, might clear a path for some of our own pursuits.

What have we become? Are we a nation of people with liberty and justice for all, or just a bunch of money grabbers stepping on each other’s liberties to pursue self-centered happiness by becoming filthy rich?

Don’t get me wrong. There’s nothing wrong with the profit motive driving business. And there’s nothing wrong with working hard and trying to make a lot of money. Those are honorable pursuits.

Army Considering Reprimanding Soldier Who Appeared With Ron Paul

The US Army said Wednesday that it is considering disciplining Reserve Corporal Jesse Thorsen, the soldier who spoke out against a militaristic foreign policy at Ron Paul’s post-Iowa caucuses rally.

After being cut short during a CNN interview Thorsen, who has served two tours in Afghanistan and was due to head back for a third, was invited on to the stage by Paul himself to address Paul’s cheering supporters.

“If there’s any man out there that’s had a vision out there, it’s definitely [Ron Paul],” Thorsen said. “His foreign policy is by far, hands down better than any other candidate’s out there, and I’m sure you all know that. We don’t need to be picking fights overseas and I think everybody else knows that, too.”

An Afghanistan war veteran is in trouble for giving a political speech while in uniform at a caucus night rally with Ron Paul on Tuesday in Iowa.

A spokeswoman for the U.S. Army Reserve told TPM on Wednesday that Cpl. Jesse Thorsen may have violated military policy when he wore his fatigues on stage and praised the Texas congressman’s presidential bid.

Thorsen’s commander is now looking into the speech and will figure out what to do next, said the spokeswoman, Maj. Angel Wallace.

The Des Moines-based soldier served in Afghanistan but hasn’t been on active duty since October, Wallace said. However, he still serves a weekend a month and two weeks a year as a reservist and may be deployed to Afghanistan again in about a year.

Thorsen seemed awestruck to stand alongside the Republican candidate on Tuesday, telling the crowd it was “like meeting a rock star.” He praised Paul’s anti-war stance.

“His foreign policy is, by far, hands down, better than any candidate’s out there. And I’m sure you all know that,” the reservist said. “We don’t need to be picking fights overseas and I think everybody else knows that, too.”

The crowd cheered, but observers who know military law cringed.

“He’s got a problem on his hands and certainly he should have known better,” said Eugene Fidell, who teaches military justice at Yale Law School. “All kinds of lights and buzzers should have gone off.”

Residents of Leesburg, Florida were shocked to see their local Social Security office turned into a random Homeland Security checkpoint Tuesday morning, as DHS officers armed with semiautomatic rifles and accompanied by sniffer dogs checked identifications of locals.

“With their blue and white SUVs circled around the Main Street office, at least one official was posted on the door with a semiautomatic rifle, randomly checking identifications. And other officers, some with K-9s, sifted through the building,” reports the Daily Commercial.

The activity was part of Operation Shield, an unannounced drill conducted by the DHS’ Federal Protective Service centered around “detecting the presence of unauthorized persons and potentially disruptive or dangerous activities.”

President Barack Obama, hitting a key swing state on Wednesday, defended his decision to recess appoint Richard Cordray to head the Consumer Financial Protection Bureau (CFPB) without Senate confirmation while the Senate is technically in session and retains the constitutional authority to confirm such appointments.

Last year, Obama nominated former Ohio Attorney General Richard Cordray to run the CFPB, which was established by the controversial Dodd-Frank financial reform law in 2010. Obama spoke on Wednesday in Cordray’s home state at the Shaker Heights High School in Shaker Heights, Ohio.

Like many Americans, initially, all of this was way too much for me to believe. I could not comprehend corruption so deep and broad. I was trained as a scientist (Ph.D. in physiology). I am not an adherent to conspiracy theories and never have been. I am simply following where the facts seem to lead.

Obama is, however, not my main concern. It is the endemic corruption in Washington, D.C., both Republican and Democrat, which has facilitated Obama’s rise to power. To me Obama is simply the most egregious example of that corruption and just the tip of the iceberg.

I believe that Obama needs to be brought down legally before the 2012 election, which will go a long way to end corruption in Washington, D.C. because the bipartisan corruption will then be fully exposed to the American people.

Paul, as expected, did well in Iowa. His strong third-place finish is substantially better than he did in 2008, and his national poll numbers are twice what they were back then. Paul’s appeal is easy to understand. His antiwar message of limited government, low taxes and federalism have strong appeal, especially to young people who oppose the war on drugs, take a pro-choice position on abortion and support gay marriage.

Paul scares people who purport to embrace freedom but fear the responsibility that goes with it. Privatize Social Security? Serious change in Medicare? Call off the war on drugs? End government welfare? He actually believes in the Constitution, an amazing document that many Americans ignore, have not read or are apparently waiting for the movie version.

A YEAR AGO THIS WEEK, just two days before being shot by a deranged assailant in her district, Arizona Representative Gabrielle Giffords introduced legislation to cut congressional salaries by 5 percent, from $174,000 to $165,300.

Needless to say, the bill didn’t become law — the last time the House and Senate actually trimmed their members’ pay was during the Great Depression. Yet there are few things Congress could do that would be more certain to win public esteem. In a national poll commissioned last month by The Hill, a Washington newspaper, 67 percent of voters said lawmakers should be paid less. With Congress’s approval rating barely above single digits, and with so many Americans feeling the sting of a weak economy, you might think support for a modest one-time pay cut would be a no brainer — especially since congressional pay has been hiked 10 times since 1998.

It’s been a year of populist uprisings, economic downturns, political assassinations, and one scandal after another. Gold prices soared, while the dollar plummeted. The Arab Spring triggered worldwide protests, including the Occupy Wall Street protests here in America. Nature unleashed her forces with a massive earthquake and tsunami in Japan, flooding in Thailand and Pakistan, a severe drought in East Africa, and a famine in Somalia. With an unemployment rate hovering around 9.5%, more than 4 million Americans passed the one-year mark for being out of a job. After a death toll that included more than 4,500 American troops and at least 60,000 Iraqis, the U.S. military officially ended its war in Iraq. At the conclusion of their respective media circus trials, Casey Anthony went free while Conrad Murray went to jail. And Will and Kate tied the knot, while Demi and Ashton broke ties. All in all, it’s been a mixed bag of a year, but on the civil liberties front, things were particularly grim.

L: Doug, a lot of readers have been asking for guidance on how to know when it’s time to exit center stage and hunker down in some safe place. Few people want to hide from the world in a cabin in the woods while life goes on in the mainstream, but nobody wants to get caught once the gates clang shut on the police state the US is becoming. How do you know when it’s time to go?

Doug: Well, the first thing to keep in mind is that it’s better to be a year too early than a minute too late. David Galland recently read They Thought They Were Free: The Germans, 1933-45, by Milton Mayer. He quoted a passage in his column of last Friday. It goes a long way in explaining why Americans appear to be such whipped dogs today. They’re no different from the Germans of recent memory. For those who missed it, let me quote it:

As I walk the streets of Manhattan, I study the other pedestrians and wonder if they sense our danger. A mother pushing her son’s stroller laughs into her cell phone; two elderly gentlemen greet each other effusively; a jogger shuffles past; shoppers lug their treasures home. No one looks especially worried or upset, and I wonder if they’ve heard about the National Defense Authorization Act of 2012 (NDAA).

How can the sun brightly shine and taxis whiz past as if nothing has changed?

With this legislation, America joins some of the modern world’s most brutal dictatorships – regimes like Nazi Germany, Mao’s China, and communist Russia. Places where people disappear into concentration camps or gulags, for any reason or, more usually, none at all. Nations in which citizens don’t count except for the taxes and labor they furnish the State. These contemporary serfs exist only to further their rulers’ whims; they dare not voice even the faintest opposition for fear of ruthless reprisal.

Rick Perry betrays the right, stays in

If Rick Perry was a legitimate conservative (which I always warned he was not) he would have dropped out of the campaign today and endorsed Rick Santorum, Ron Paul or Newt Gingrich. Yet “Pay-for-Play” Perry stays in, and heads for South Carolina. So what’s the deal?

The big winner of Perry staying in, by far, is Mitt Romney. The big loser is the conservative movement and the candidates who appeal to that movement. Keeping in mind my long-held view that Perry is not conservative, just a “pay-for-play” guy, what is in it for Perry?

1. Perhaps Romney offered Perry a position in his administration, such as undersecretary of Agriculture.

2. Perhaps Romney offered Perry a diplomatic post suited to his talents, such as United States Ambassador to Bolivia.

3. Perhaps Perry spent more of his money than we realize, and Romney offered to go to his 1 percent wealthy fundraisers and raise for Perry a little more dough to sweeten the pie.
