Georgia Judge Rules Against Plaintiffs: Attorney Mark Hatfield “taking it up on appeal”

Greetings,

As you know we were expecting word out of Georgia today and we got it. Late this afternoon Judge Malihi issued his ruling against all four Plaintiffs.

We caught up with Swensson/Powell’s counsel, Mark Hatfield, late this afternoon to get his initial take on the ruling. Here is what he stated “obviously we are disappointed w/the decision, but there are a couple of items in the ruling that we are looking at. First, the Judge never made any ruling on who has the burden of proof even though he indicated in chambers prior to the hearing that making the determination of the burden of proof laid with Defendant Obama.” He went onto state “the Judge has a record of placing the burden on the candidate, but didn’t do so in this case.” Another point Hatfield made was the “Indiana Court of Appeals ruling in Arkeny elevates the Indiana case above the Constitution” while also noting the Judge ignored the Minor court in Minor v Happersett, a ruling that clearly defined natural born Citizen, established precedent. When asked about next steps Hatfield stated “we are going full bore and taking it up on appeal”.

This tableau is called “The Forgotten Man”, a painting by Jon McNaughton, an artist who is known for his politically-charged work.

The painting, which uses objects such as discarded dollar bills as symbols and scraps of paper with individual constitutional amendments scrawled onto them, has been making the rounds across the Internet.

Yoram Cohen said that Iran’s Revolutionary Guard, the same militant wing of the government linked to the recent alleged plot against the Saudi ambassador to the U.S., is working tirelessly to attack Israeli and Jewish targets abroad in order to deter Israel.

As we have previously reported, many of the behaviors characterized as potential signs of terrorism by the TSA in its training procedures are mundane activities performed by a majority of people, including using a video camera, talking to police officers, wearing hoodies, driving vans, writing on a piece of paper, and using a cell phone recording application.

(Feb. 3, 2012) — In December 2011, the Environmental Protection Agency released new Clean Air Act “National Emission Standards for Hazardous Air Pollutants.” Once again, EPA Administrator Lisa Jackson touted the supposedly huge benefits of controlling emissions of mercury (Hg) and other air toxics from U.S. coal- and oil-fired power plants (or electric generating units, EGUs).

The people of Idaho may welcome this new rule, since EPA’s miraculous modeling machine has promised to prevent “six premature deaths” and create “up to $54 million” in health benefits by 2016 – even though not one coal-fired EGU in Idaho fits the EPA’s final rules. Even the District of Columbia, which has only one oil-fired unit, will somehow, magically realize “up to $120 million” in health benefits, presumably from new restrictions on coal-fired units in Maryland or Virginia.

The average U.S. citizen, however, can be excused for no longer being willing to be penalized by EPA – the Extreme Punishment Authority – for such minimal, imaginary and manufactured benefits.

Orly Taitz, who on February 1 filed a “Proposed Findings of Law and Fact” with the Office of State Administrative Hearings in Atlanta, GA following last Thursday’s hearing, told The Post & Email that evening that she does not believe that Atty. Michael Jablonski, Obama’s local counsel in Georgia, submitted anything to Judge Michael Malihi by the deadline, who on January 26 heard evidence and testimony refuting Obama’s constitutional eligibility to run for President.

Video of the hearing, which lasted approximately one hour and 45 minutes, is here. The Post & Email’s real-time report was published the morning of the 26th, after which our website was taken down by its hosting company, beginning a nightmarish eight days of mostly downtime while we paid for two hosting accounts. We are still in a state of flux in regard to stable website hosting.

This morning Taitz said that “nothing yet” had been received by the court from Jablonski.

Judge Malihi had denied a Motion to Quash Subpoenas on the part of Obama’s attorney and “ordering the president to appear in court,” according to a local news report. Obama’s attorney, Michael Jablonski, had stated that he had “suspended participation” in the hearing and did not appear on his client’s behalf.

(Feb. 2, 2012) — While the groundhog was seeing his shadow early this morning, a young man on the other side of the world was going back and forth between two hosting accounts at GoDaddy.com, checking to see which files had been moved and which had not out of a total of 30 tables and tens of thousands of records, all consisting of the building blocks which make The Post & Email run.

We were afforded the opportunity to see the process up close for approximately three hours today as the work was arduously completed, back and forth between two screens, multiple choices and bright red error messages. The WordPress specialist kindly said he would “show” me how it was done, but truth be told, your editor will never learn how to do it. My brain is just not wired that way.

Give me words, not numbers. I’ll write about an idea, but I’ll never figure out which records need to be downloaded on one computer while working with multiple databases, identifying missing files, and reassembling an extremely complex virtual edifice to a complicated website. Add trying to teach an unteachable person the mathematics and mechanics of doing so, and you have one patient man!

The headline news item on Drudge report says “RASMUSSEN: Obama 45% Romney 45%… Developing… “

What I’m wondering is why is this significant overall, because…what about the electoral college? Obama could just barely beat Romney or Gingrich in the popular vote, yet lose the election. Just ask “President Gore”.

“Gore Got More” was one of the sayings, and he did.

According to Wikipedia, Al Gore got 50,999,897 votes. 48.4 per cent. Bush got 50,546,002 votes or 47.9 per cent.

If this country elected a President on popular votes, Gore would have been sworn in on 1/20/01. But we use electoral votes. Wiki. said Bush won 30 states. Gore won 20 states plus D.C. (Obama is probably wondering how the other 7 states voted.)

No wonder they argue for a “National Popular Vote” on the Left.

Anyway, you see polls like this but isn’t what matters the state-by-state vote?

His home state of Tennessee. Bush won 271 EV, Gore 266. If Tenn. went for Gore it would have been Gore 277, Bush 260.

Electoral college…what really should matter in these polls. Yes, popular vote is a good indication of how the race is going, but not the only one.

You know that “check engine” light on your dashboard? What if instead of just telling you that the car’s computer has detected some fault with the emissions control system, it told the government – via roadside readers and satellite uplinks?

It’s called OBD III – and it’s right around the corner.

All new cars builtsince the mid-1990s have OBD II – or On Board Diagnostics II. This system standardized diagnostics by specifying that every new car come equipped with an OBD port (usually located somewhere near the driver’s side kick panel, on the underside of the dashboard) into which a technician (and your state’s emissions test station) can plug a scanner that downloads stored “trouble codes.” It is these trouble codes that also trigger the yellow “check engine” malfunction indicator light on your dash.

When President Obama announced last April that he was sending the United States military to bomb Libya, he not only violated the United States Constitution, which he has taken an oath to uphold, but he also violated the moral principles of the just war. The Constitution permits only Congress to declare war and the president to initiate on his own only a truly defensive war. When the president takes an oath to uphold the Constitution, he also promises to uphold the treaties into which the U.S. has entered and the laws that have been written pursuant to those treaties.

St. Thomas Aquinas is the modern articulator of the idea that governments are required to follow the same moral principles as the rest of us. This is particularly so in the case of a government that claims its source of power is the consent of the governed. St. Thomas More once put it this way: “Some men say the earth is round and some say it is flat. If it is round, can the King’s command flatten it; and if it is flat, can Parliament make it round?”

Of course, the answer to those questions is no; and the reason it is no is that kings and parliaments – all governments – just like all living beings, are subject to the laws of nature. One of those laws was articulated by Aquinas and embraced by More and accepted by Thomas Jefferson and taught by many Judeo-Christian scholars, and was eventually engrafted into treaties and into American law. It is the concept of the just war. In American law and culture, for war to be valid, it must not only be lawful, meaning either declared by Congress or defensive; it must also be just.

What is a just war? For a war to be just, generally, a half-dozen principles must be met.

First, since force destroys, and there is a presumption against its use, the presumption must be overcome by first using all peaceful and viable means and alternatives to war; and it must be clear that these alternatives are fruitless before a war can be just.

The American Civil Liberties Union filed a lawsuit this week against the Department of Justice, the Department of Defense, and the CIA, demanding the release of any information pertaining to the deaths of three American citizens resulting directly from drone missile strikes in 2011.

Details regarding the deaths of accused Al Qaeda leaders Anwar al-Awlaki and Samir Kahn, both American citizens, have been kept under wraps. Both men were reportedly killed in targeted drone attacks last year in Yemen.

The third US citizen to be killed was Awlaki’s 16-year-old son, Abdulrahman, who was killed in a drone attack two weeks after al-Awlaki and Kahn.

At the time Obama described the death of Awlaki as a “significant milestone” in the war on terror.

“Our government’s deliberate and premeditated killing of American terrorism suspects raises profound questions that ought to be the subject of public debate,” Nathan Freed Wessler of the ACLU writes.
