Government is bad for personal freedom. That argument is premised upon the truism that everything government does interferes with freedom because it either prohibits or compels. Everything it owns it has taken from others. Much of what it says is divorced from the truth. President Obama, like President George W. Bush, has argued that his first job is to keep America safe, and if he impairs personal freedom in the process, that is a small price to pay for safety. Many of my colleagues in the media on the left and right have bought this argument, notwithstanding its fallacies.

Judge Andrew Napolitano weighed in this morning on Fox and Friends on the scandal involving the IRS‘s targeting of conservative political groups, like the Tea Party.
The IRS admitted last week after years of pressure from conservative watchdog groups that it had in fact been singling out right-wing organizations for extra scrutiny of their applications for tax-exempt status.
The judge said the IRS’s actions appear to be a clear violation of the First Amendment.

The government’s fidelity to the Constitution is never more tested than in a time of crisis. The urge to do something – or to appear to be doing something – is nearly irresistible to those whom we have employed to protect our freedom and to keep us safe.
Regrettably, with each passing violent crisis – Waco, Oklahoma City, Columbine, 9/11, Newtown and now the Boston Marathon – our personal freedoms continue to slip away, and the government itself remains the chief engine of that slippage.
The American people made a pact with the devil in the weeks and months following 9/11 when they bought the Bush-era argument that by surrendering liberty they could buy safety. But that type of pact has never enhanced either liberty or safety, and its fruits are always bitter.

An outspoken libertarian and anti-drone advocate, Judge Napolitano went one step further and railed against the concept of “drones all over the place,” including ones that eventually could be the “size of mosquitoes.”
The best way to combat that potential onslaught? “You need a warrant for that,” Judge Napolitano suggested. “Without a warrant, police will use them to look at you in your bedroom or in hot tub. And without a warrant, because it’s easier to do so.”

Ron Paul has been retired from Congress for only a few months, but he’s certainly not shying away from politics. The former US representative has already announced his new project: the Ron Paul Institute for Peace and Prosperity.
In a press release sent to the media Friday afternoon, the Ron Paul camp confirms that the long-time Texas representative will launch a think-tank of sorts in order to carry on his ideologies after his time in office has ended.
“After decades in and out of the US House of Representatives leading the call for a non-interventionist foreign policy and the protection of civil liberties, Dr. Paul is launching a revolutionary new vehicle to expand his efforts. The Institute will serve as the focal point of a new coalition that crosses political, ideological and party lines,” the statement begins.

While the press in Colorado is consumed with its coverage of the capital murder prosecution of James Holmes for the slaughter he perpetrated in a movie theater in the town of Aurora on July 20, 2012, a related court proceeding is taking place in the same courthouse that the local and national press would be wise to cover.
My Fox News colleague, Jana Winter, an experienced journalist of impeccable integrity, is being threatened with incarceration by a Colorado judge unless she reveals the sources for the excellent and highly newsworthy piece she wrote for FoxNews.com revealing the existence of a notebook written by Mr. Holmes before the murders and sent to his psychiatrist, Dr. Lynne Fenton.
Winter’s report cited unnamed law enforcement sources and the defense immediately complained that investigators had violated the judge’s gag order issued days beforehand.
Putting reporters in jail for revealing the truth while protecting their sources is highly offensive to the values the First Amendment was written to protect.

On Fox’s America Live this afternoon, senior judicial analyst Judge Andrew Napolitano took on the news of how a judge ruled that Stockton, Calif., can become the first American city to declare bankruptcy by slamming the local government’s “reprehensible” spending habits that led to their dodging debt obligations via insolvency.
“Stockton is the beginning of a very long train,” Napolitano said before recalling all the various debts the city holds to other government bodies. “Where is the money going to come from?” he asked.
“This is reprehensible what the politicians did in order to get votes,” he continued. “How did they get votes? By giving lavish deals for people who will continue to keep them in office. They either never thought they’d run out of cash or the cash would run out not on their watch; and they also, of course, wrote laws that would benefit themselves because the politicians making these laws would themselves be pensioners some day. So these pensions are lavish and generous and noncontributory, comes from the taxpayers.”

Amanda Knox’s American lawyer said that she’s upset but is ready to fight and prove her innocence. It’s unclear whether Knox will return voluntarily to Italy or whether she’ll be extradited—there’s also a chance she may face trial in absentia.
Knox spent four years in prison before an Italian appeals court threw out her murder conviction in 2011 and she had been hoping the court would uphold the appeals court ruling and end her six year ordeal.
