A silver lining for conservatives in the Supreme Court’s health care decision Thursday is that the court allowed the law to stand based on the idea that the individual mandate was a tax.

That news has Republicans and conservative radio talk show host Rush Limbaugh bringing out an old — and incorrect claim — that the health care law constitutes the largest tax increase ever.

Patrick Kennedy, a former representative from Rhode Island and son of the late Ted Kennedy, warned in a fundraising email for Congressional Democrats that if the U.S. Supreme Court upholds President Obama’s health care law, then “dangerous Tea Party extremists will go on a rampage.”

Boehner: If Supreme Court strikes down health care law, ‘there will be no spiking of the ball’

The Supreme Court is expected to rule on the constitutionality of President Barack Obama’s health care law within the next week, and House Speaker John Boehner has issued a pre-emptive warning to fellow House Republicans if parts of the law are struck down: Forget about celebrating.

In a memo sent to his entire caucus Friday, Boehner warned members not to gloat over what most Republicans would see as a victory.

“[I]f the Court strikes down all or part of the president’s health care law, there will be no spiking of the ball,” Boehner wrote in the memo. “Republicans are focused on the economy—and under President Obama’s policies, our economy is struggling. We will not celebrate at a time when millions of our fellow Americans remain out of work, the national debt has exceeded the size of our nation’s economy, health costs continue to rise, and small businesses are struggling to hire.”

House Democratic Leader Nancy Pelosi on Thursday defended the health care reform law, tying it to the promises written in the Declaration of Independence.

The Affordable Care Act is “about life, liberty and the pursuit of happiness for the American people,” Pelosi told reporters on Capitol Hill. She said it “unlocks” them from a job to pursue happiness without the threat of losing their health insurance.

When asked why she is so confident the Supreme Court will uphold the health care law, Pelosi says, “Because I know the Constitution.”

“This bill is ironclad,” she continued. “It is ironclad. Nobody was frivolous with the Constitution and the health of the American people in writing the bill,” she said. “So, that’s where my confidence springs from, the merit of the bill and the nature of the Constitution. The makeup of the court, well, we’ll see.”

House Minority Leader Nancy Pelosi on Tuesday predicted the Supreme Court will uphold the health care law on a 6-3 vote, saying she and her colleagues “wrote the bill in an ironclad way.”

“I’m predicting 6-3 in favor,” Mrs. Pelosi told the Paley Center for Media. “We shall see. It’s a lesson in civics, and I respect it.”

She didn’t say which six justices she thought would uphold the law.

Unlike the White House, which said it is not thinking ahead to what happens if the court strikes down part or all of the law, Mrs. Pelosi did grapple with that question, saying Congress will have to find a way to make sure that the benefits she said are now going to 80 million people must be preserved.

Feds May Act if Florida Stalls on Health-Reform Law

If Florida leaders refuse to carry out the new national health-care law, Uncle Sam is prepared to take charge on behalf of the state’s consumers.

One year after President Barack Obama signed the health-care overhaul into law, federal officials are urging Florida and other reluctant states to shape it to meet their needs and to take advantage of millions of dollars of federal planning grants. Failure to participate, officials warned this week, means a loss of state control.

But Florida Gov. Rick Scott — backed by fellow Republicans in the Legislature who strongly oppose “ObamaCare” — has refused $2 million in federal planning money and ordered state agencies not to implement the law. In addition, Florida has challenged the law in federal court, in a lawsuit filed before Scott was elected in November.

“We believe the federal law is unconstitutional, in which case it won’t be enforced,” said Jack McDermott, spokesman for the Florida Office of Insurance Regulation.

A federal judge in Florida recently ruled that the entire health care law is unconstitutional – a ruling Judge Roger Vinson described as “the functional equivalent of an injunction.”

But that hasn’t stopped the Obama administration from spending hundreds of millions of dollars authorized by the disputed law.On Wednesday, Health and Human Services Secretary Kathleen Sebelius announced a $750 million investment in prevention and public health — funded through the Prevention and Public Health Fund, which was created by the new health care law.

President Obama’s assertion on Sunday that he “didn’t raise taxes once” is “blatantly false,” a taxpayer watchdog group says. Obama made the claim in his pre-Super Bowl interview with Fox News host Bill O’Reilly.According to Americans for Tax Reform ATR, President Obama has signed into law at least two dozen tax increases.

The first one – a federal tobacco tax hike – came just 16 days into his presidency.ATR says the $1 trillion health care overhaul alone added numerous taxes, including the individual mandate that requires most Americans to purchase health insurance or else pay a fine.During the legislative debate, Obama and Democrats in Congress argued that a penalty for not carrying insurance is not a tax.

But in recent attempts to defend Obamacare as constitutional, the Obama Justice Department has called the penalty a tax.The health care law’s employer mandate provision also should be considered a tax, ATR said.

That provision requires companies to report all business-to-business sales of goods and services exceeding $600 to the Internal Revenue Service. In a bipartisan vote, the Senate recently voted to repeal the so-called 1099 provision, and Obama says he supports the repeal.The health care law also includes a tax on medical device manufacturers, as well as a higher tax on withdrawals from health savings accounts and a cap on flexible spending accounts……………………
