Central Intelligence Agency director David Petraeus has emphatically denied that he or anyone else at the CIA refused assistance to the former Navy SEALs who requested it three times as terrorists attacked the U.S. consulate in Benghazi on the night of Sep. 11. The Weekly Standard and ABC News (report) that Petraeus’s denial effectively implicates President Barack Obama, since a refusal to assist “would have been a presidential decision.”

News’ Jake Tapper asked White House Press Secretary Jay Carney about Health and Human Services (HHS) Secretary Kathleen Sebelius violating the Hatch Act, at today’s press briefing. Carney responded that Sec. Sebelius had made an “inadvertent error based on extemporaneous remarks.”

Reuters’ Mark Hosenball today reported http://www.reuters.com/article/2011/10/05/us-cia-killlist-idUSTRE79475C20111005 that: “American militants like Anwar al-Awlaki are placed on a kill or capture list by a secretive panel of senior government officials, which then informs the president of its decisions, according to officials.

There is no public record of the operations or decisions of the panel, which is a subset of the White House’s National Security Council, several current and former officials said. Neither is there any law establishing its existence or setting out the rules by which it is supposed to operate.”

Even after it was thoroughly debunked, Obama mentioned it anyway to drum up dollars at his ritzy $35,800 per plate Facebook fundraiser tonight.

Jake Tapper and Ed Henry live-Tweeted the speech

… An individual, via those in attendance, hollered at the health care story and the audience rebuked them. Two men booed the gotcha question posed by a gay soldier and they were so strongly rebuked for booing that the audience’s hisses and shushes overpowered the volume of the rude men’s outburst.

I’d say that the President “grossly misstated” the true nature of these incidents, but that would be inaccurate. It was a lie to willfully misstate that the actions of a couple of individuals were instead from the entire audience.

In the meantime, this same President, so eager to condemn conservatives for what two individuals did (do we know if they’re even conservatives?) was silent when 500 men from guest of honor Trumka’s group stormed a port, took hostages, and damaged property (don’t forget, Trumka sat with the First Lady at Obama’s jobs address that same night).

The Obama administration has photographs of Osama bin Laden’s dead body and officials are debating what to do with them and whether they should be released to the public, officials tell ABC News.

“There’s no doubt it’s him,” says a US official who has seen the pictures and also reminds us that OBL was 6’4”.

The argument for releasing them: to ensure that the public knows and can appreciate that he’s dead. There is of course skepticism throughout the world that the US government claim that it killed bin Laden is true.

The argument against releasing the pictures: they’re gruesome. He has a massive head wound above his left eye where he took bullet, with brains and blood visible.

In July 2003, the US government released photographs of Saddam Hussein’s dead sons Uday and Qusay Hussain but not until after they’d been touched up by a mortician, making them look not quite real.

Clinton & Gates Suggest Constitution No Longer Supreme

Recall how confused many of us were by the Obama candidacy? Remember how we laughed at “community organizing,” “hope,” and “change?” Do you recall the promise of “fundamental transformation,” and how few of us understood what it really meant?

If we learned anything from the Obama candidacy, it’s that we ought to be on our highest guard when this president is at his most perplexing. It is a mistake to dismiss what seems nonsensical and assume there is no method to the madness.

Since American military action began against Libya, confusion has reigned among policymakers and pundits. Some have pointed out the glaring inconsistency between President Obama’s past comments and his current actions, while others stretch the limits of credulity in an attempt to reconcile the disparity.

Secretary of State Hillary Clinton added to the cacophony on Sunday. She appeared alongside Secretary of Defense Robert Gates on ABC’s This Week. In response to questioning by Senior White House Correspondent Jake Tapper, Clinton provided some insight into the administration’s mindset. It suggests that, while the rest of us may be confused, this administration may not be.

During his campaign for the Presidency, in December, 2007, Barack Obama told The Boston Globe that “The President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation.”

Earlier in 2007, then-Senator Hillary Clinton said in a speech on the Senate floor that, “If the administration believes that any — any — use of force against Iran is necessary, the President must come to Congress to seek that authority.”

Tapper asked Clinton, “Why not [go] to Congress [to authorize action against Libya]?…”

It seems no matter where President Obama goes, he continues to be called a “fellow Kenyan” for some strange reason by Kenyan officials.

As reporter Jake Tapper of ABC News notes, “There was an odd little moment with Spice Jet founder Bhupendra Kansagra when President Obama spoke to CEOs Saturday in Mumbai.MR. KANSAGRA: “Thank you. Welcome, Mr. President, to India.

As a fellow Kenyan, I’m very proud to see that you have made –THE PRESIDENT: “Made something of myself.” Laughter.MR. KANSAGRA: —

India as the focus of your drive for exports out of the U.S.Tapper, who has been critical of reports casting doubt on Obama’s birthplace, closed his brief story by stating, “Obviously the president is not a Kenyan.

One supposes Mr. Kansagra meant ‘of Kenyan ancestry’ or something.”Already, a video has been posted on YouTube making note of the incident.

For most of Rush’s show yesterday, he naturally discussed Tuesday’s elections and their implications. But then in the second hour he went into a monologue in response to a seemingly innocent exchange between President Hope&Change and ABC NewsJake Tapper at yesterday’s press conference Obama‘s first in months, Rush noted. Tapper asked that, now that the Republicans have taken the house, would he be willing to compromise on at what amount of income taxes would be raised.Obama’s non-answer answer notwithstanding, the question itself sent Rush into a tizzy, because he realized that the government has no Constitutional authority to determine any of this and he laments that nearly all of us have submissively fallen for the premise that they do.Here’s the clip, and the transcript from his site below. It’s quite fantastic, a must-hear. One might even argue it’s Rush’s first call to arms for November 2012.… Jake Tapper, ABC, asked Obama about the compromise that he might make on extending the Bush tax cuts.
