The United States is no longer what John Adams described as a government of laws and not of men. It has become the opposite.
Many of those presently in the federal government have violated their oaths of office to support and defend the Constitution, they have obstructed justice and they have scorned and rejected citizens’ attempts to petition for the redress of grievances.
The continuous stonewalling by both parties’ elite is clearly directed toward preventing an investigation that would reveal a federal government riddled with corruption and that operates solely for the benefit of politicians and their wealthy power-brokers.
The conspiracy of silence by the political establishments and the associated news blackout by a compliant media can only be explained by complicity in a cover-up of criminal acts that, if they became known, would enrage the American people and rock the political system to its core.
If there is another explanation, I would like to know it.

As Abraham Lincoln noted, the American people are the rightful masters of both Congress and the courts, not to overthrow the Constitution but to overthrow the men who pervert the Constitution. The loyalty of the American people is to our country and our Constitution, not to shady officeholders or petty bureaucrats.
For too long we have been silent and inattentive. We must now overthrow those responsible for the endemic corruption in our federal government.

Free expression in all forms is fundamental in democratic societies. Without it, all other freedoms are at risk.
Included are free speech, a free press, freedom of thought, culture, and intellectual inquiry. It also includes the right to challenge government authority peacefully, especially in times of war and cases of injustice, lawlessness, official incompetence, and abusive government behavior.
Denying it risks tyranny. Voltaire defended it, saying “I may disapprove of what you say, but I will defend to the death your right to say it.”
Howard Zinn called dissent “the highest form of patriotism.” It includes the right to speak and write freely, assemble, protest publicly, and associate with anyone for any reason lawfully.
Democracy depends on it. Bill of Rights freedoms affirm it. Nonetheless, US history is strewn with abusive laws. The 1798 Sedition Act criminalized publishing “false, scandalous and malicious writing” against President John Adams or Congress, but allowed it against Vice President Thomas Jefferson.
The 1917 Espionage Act imprisoned anyone convicted of “insubordination, disloyalty, mutiny, or (encouraging) refusal of duty in the military or naval forces of the United States.”
It targeted First Amendment speech against WW I and American’s participation in it. The 1918 Sedition Act went further. It criminalized “disloyal, scurrilous (or) abusive” anti-government speech.

In the Year 1839, John Quincy Adams, son of John Adams, and himself a President of the United States, was invited by the New York Historical Society to speak on the 50th Anniversary under the Constitution. His extensive “Jubilee” Address can be read here. The following relatively short review of the history he summarized in the final portion of his Address is excerpted here:
The President himself is no more than a representative of public opinion at the time of his election; and as public opinion is subject to great and frequent fluctuations, he must accommodate his policy to them; or the people will speedily give him a successor; or either House of Congress will effectually control his power. It is thus, and in no other sense that the Constitution of the United States is democratic – for the government of our country, instead of a Democracy the most simple, is the most complicated government on the face of the globe. For years, retired Penn State chemistry professor Julian Heicklen has handed out literature to passersby in front of the Manhattan courthouse, informing them of the rights of jurors. …..After a lucid explanation of each section of the Constitution the judge discusses how the nationalist/mercantilist coalition, led by Alexander Hamilton and his accomplice Judge John Marshall, conspired to effectively rewrite (and undermine) the Constitution almost as soon as he ink was dry on the original copy.
The “Federalists” (who would eventually morph into the Whigs, and then the Republicans) never accepted their defeat in the Constitutional convention (which created a federal, not a national government). Nor did they accept Jefferson’s election as president.
Thus, two days before his term ended the Federalist President John Adams appointed dozens of “midnight federal judges” and appointed John Marshall to the Supreme Court on March 3, 1801, one day before he would leave office. Marshall “spent the remainder of his career finding clearly disingenuous, historically inaccurate, and highly questionable justifications for ruling that federal power is not limited,” writes Judge Napolitano.
In his most famous decision, Marbury vs. Madison, Marshall gave the federal judiciary the power to rule on the constitutionality of both statutory law and the behavior of the executive branch. “[T]his means that the Supreme Court granted itself the authority to declare the will of the people . . . null and void . . .” This of course has caused endless mischief and tyranny. This principle of a monopoly in reviewing constitutionality was not widely accepted, however, until after Lincoln’s war of 1861—1865 destroyed state sovereignty once and for all.
Until that point, many Americans believed that the citizens of the states, as well as the president and Congress, should have equally legitimate claims on interpreting the Constitution. As President Andrew Jackson famously said, “John Marshall has made his decision, now let him enforce it if he can.”
Marshall and his fellow Federalists, such as Justice Story, also paved the way for the Supremacy Clause of the Constitution. This clause only grants “supremacy” to the central government on the seventeen specific functions of the central government that are delineated in Article I, Section 8, period, many of which have to do with waging war and foreign policy.
This power has been grossly abused by implying that the central government is somehow “supreme” in anything and everything vis-à-vis the citizens of the states. This of course is a perfect recipe for tyranny.
Judge Napolitano recognized that it was Federalists like Joseph Story and John Marshall, and later Whig politicians like Daniel Webster and Abraham Lincoln, who would tell The Big Lie that the Constitution was ratified by “the whole people” and not as it actually was — by the citizens of the sovereign states, with their representatives assembled in state conventions. “That was both historically incorrect and intellectually dishonest,” says Judge Napolitano.
According to this false view of the American founding the central government was always the master, not the servant, of the people. This, too, is a perfect recipe for tyranny that has been made by tyrants everywhere (Hitler even invoked this argument in Mein Kampf to make his case for destroying state sovereignty in Germany)…..

Thank you for your response. First, let me wish you and your family a Happy Thanksgiving.
The core arguments of my articles are that the Democrat and Republican parties at the national level, i.e., the Congress and the national committees are corrupt and they do not uphold the Constitution. Obama and his Administration are simply the most flagrant examples.
Except for Rick Perry, to some extent, and Sarah Palin as a non-candidate, no Republican candidate has directly addressed the issue of corruption, which, for me, is the central issue of our time.
Nor has the leadership of the Republican Party taken a stand on Obama’s ineligibility for the Presidency (it does not matter where he was born, see article below) or his crimes both before and after occupying the Oval Office.
In fact, the Republican Party has joined the Democrats and the mainstream media to suppress discussion of these issues, have actively distributed misinformation and deliberately misdirected citizens.
Hundreds of my readers have written one or more letters to their Congressional representatives about these issues only to be ignored or ridiculed.

In his 1850 Disquisition on Government, John C. Calhoun argued that a written constitution would never be sufficient to contain the plundering proclivities of a central government. Some mechanisms for assuring consensus among the citizens of the states regarding “federal” laws would be necessary. Consequently, Calhoun proposed giving citizens of the states veto power over federal laws that they believed were unconstitutional (the “concurrent majority”). He also championed the Jeffersonian idea of nullification. To Calhoun (and Jefferson), states’ rights meant that the citizens of the states were sovereign over the central government that they created as their agent, and could only be so if such mechanisms – including the right of secession – existed.
Without these political mechanisms the forces of nationalism, mercantilism, and political plunder would relentlessly reshape the Constitution with their rhetoric, and their efforts would eventually overwhelm the strict constructionists. At that point the Constitution would become a dead letter.
In his new book, The Constitution in Exile, Judge Andrew Napolitano explains in very clear language just how prescient Calhoun was. The biggest special-interest group of all – the federal government itself – has “seized power by rewriting the supreme law of the land,” as Judge Napolitano says in the subtitle to his book. Just as Calhoun predicted. The purpose of the book, says the judge, is to tell “the unhappy story of liberty lost, federalism trampled, and Big Government run amok.” How did we get to the point, he asks, of where the “federal” (i.e., central) government defines for us the drinking age for alcohol, how much wheat farmers can grow, the ability of terminally ill cancer patients to medicate themselves with marijuana, the amount of sugar that can be used in ketchup, and even the size of toilets?
Unlike the neocons who surround Judge Napolitano in his appearances on the FOX News Channel, he understands that freedom comes “from God and is inherent to our humanity . . .” “Freedom” is not derived from military adventurism under the guise of phony humanitarianism, as the David Horowitz/William Kristol/Rush Limbaugh/ crowd would have us believe. (For an amusing rendition of this fascistic theory take a look at the web site of the “David Horowitz Freedom Center“).
Judge Napolitano is one libertarian who is not intimidated by the forces of political correctness, a defining feature of so many “beltway libertarians.” Consequently, he is not afraid to recognize the truth about the American founding: “The states were sovereign entities that the Continental Congress could not directly control. Essentially, there was no binding central government” Even better, “Congress could not tax the people of the United states (Ah, the good old days!)” Advocates of centralized governmental power have long falsely associated statements about states’ rights with racism and slavery, which has intimidated most beltway libertarians, but not Judge Napolitano.

Did You Love America?
Do you realize our country, the country many of us loved, and were willing to lay down our lives for, is no more? Don’t despair my fellow refugees and citizens of our beloved former America, but please do come to terms with the fact that our country was ill and dying for decades and it has now ceased to exist as we once knew it.
Nevertheless, this is not intended as an essay of gloom, but as a signpost denoting the reality of where we are, and an ensign for some, of the second American Revolution that has already begun without them. During its lifespan, the United States had forty and four men who called themselves President, but history likely will record the official number as forty-three, with George W. Bush as its last, and among the worst in the first dispensation of American independence.
John Adams loved the spirit of revolution inspired by Thomas Paine’s pamphlet, Common Sense, but he also bemoaned at length the “leveling spirit” of unbridled democracy. Adams correctly believed, there was no good government that was not a Republic. He felt there was not yet sufficient civic virtue in the colonies to support a Republic, and so he counseled against immediate abandonment of the accepted property-based franchise in determining a right to vote.
Adams was concerned that every man without a farthing would eventually, “demand an equal voice in all the acts of state.” Even though his lament included women and children voting, his point was clear considering the times, that only those who had the wherewithal to think and act rationally should be allowed to vote. Otherwise we would suffer a democratic legislature that would use “the will of the people” to enforce tyranny…which is precisely where we are today.
To a point, Adams had been somewhat conservative in his approach to independence compared to his more radical contemporaries. He was home in Braintree when he heard news of British troops firing on the Minutemen at Lexington, and at that instant, John Adams ceased to be a disgruntled subject of the King…but rather, he and many others, were instantly transformed by that act of aggression, into 100% red-blooded Americans.
In early March of 1775, American and British cannons roared at the Siege of Boston, rattling windows in Braintree some twelve miles away. John Adams’ wife Abigail and their children were in Braintree, where she wrote to her husband, “Cannon continued firing and my heart kept pace with them all night.” Adams had left his cherished wife and children to fend for themselves, and his once prestigious law practice had vanished in his absence. What was it that drove the “Host of Worthies,” as Jefferson called them fifty years later, to such extreme action?
While Southern aristocrats called for peace, and insisted that British commissioners were on their way to reconcile with the colonies, Adams dismissed such hope as an “airy fairy,” and pushed for escalation of the war. In May, Adams wrote Abigail and told her Great Britain had, “at last driven America to the last step, a complete separation from her.” He said there is, “something unnatural and extremely odious in a government 1000 leagues off. A whole government of our own choice, managed by Persons whom We love, revere and can confide in, has charms in it, for which Men will fight.”
And there it is…good government for which men will fight, and the odiousness of a government 1000 leagues off. How far off are the puppet masters pulling the strings of the usurper in the White House and our deaf representatives from both political parities? We have come full circle…we are again but a collection of colonies wanting representation, but not getting it, needing protection from a foreign invasion, but having the invasion aided by those who should, but do not protect our borders.
Our national seat of government is under siege, our country is in dire straits, and we are without a pulse of representation, but the nation’s lifeblood is in her people, and the nation’s heart beats within our own breasts where the Constitution is indelibly written…and there is where it lives on, not in Washington. The first dispensation of American independence took a deadly detour under FDR, and has just recently passed away from the affliction.
It is now up to us to insure that the invading government run by the tyranny of democratic mob rule does not stand, but that a Republic rededicated to the rule of law and limited by our Constitution, shall not perish from the earth. Restoring America and American liberty will require a complete rejection of the illegal presidency of the Obama administration, and a complete removal of both houses of Congress, but it can be done.
John Adams returned to Boston the morning after the Boston Tea Party. He wrote in his diary, “Last night, 3 Cargoes of Bohea Tea were emptied into the Sea. This morning a Man of War sails. This is the most magnificent Movement of all. There is a Dignity, a Majesty, a Sublimity in this last Effort of the Patriots that I greatly admire. This Destruction of the Tea is so bold, so daring, so firm, intrepid, & inflexible, and it must have so important Consequences and so lasting, that I cannot but consider it as an Epocha in History…The Question is whether the Destruction of this Tea was necessary? I apprehend it was absolutely and indispensably so.”

Enemies within the Patriot Movement
Like conservatives, libertarians claim to want smaller government, lower taxes and fiscal sanity. It sounds good on the surface. But, unlike conservatives, libertarians are happy to let social ills run wild, so long as nobody sends them the tab for the natural consequences of a society without moral limits.
True constitutional conservatives understand what John Adams meant when he said – “We have no government armed with power capable of contending with human passions unbridled by morality and religion. Avarice, ambition, revenge, or gallantry, would break the strongest cords of our Constitution as a whale goes through a net. Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.”
Libertarians make no such connection…

Myself, I think, NO…a potus would not allow such a thing; nor would the generals and admirals consider allowing such a thing on their own.
What the troops think/do themselves is beside the point, as they would, for the most part, ultimately follow orders in any case. But some reading this would question this point too.Those, if any, who failed to follow orders would be… ineffective.
This question can be likened to the members of the scotus, congress and other responsible individuals and groups who are said to have failed to do the right thing in many instances in recent history, and actually throughout our history.
Many reasons have been cited for this…but here we are up to our arses in alligators w/o a paddle, so to speak.
This is a question that many have turned over in their minds but are reluctant to speak on, and for good reason due to…call it PC…at one level or another.

The Men Who Destroyed the Constitution

In his 1850 Disquisition on Government, John C. Calhoun argued that a written constitution would never be sufficient to contain the plundering proclivities of a central government. Some mechanisms for assuring consensus among the citizens of the states regarding “federal” laws would be necessary. Consequently, Calhoun proposed giving citizens of the states veto power over federal laws that they believed were unconstitutional (the “concurrent majority”). He also championed the Jeffersonian idea of nullification. To Calhoun (and Jefferson), states’ rights meant that the citizens of the states were sovereign over the central government that they created as their agent, and could only be so if such mechanisms – including the right of secession – existed.
Blame the Electorate, Not Congress, For America’s Woes
Even though Charlie Reese retired over two years ago as a syndicated columnist, several of his columns continue to orbit cyberspace. Not too long ago one of Reese’s pieces landed in my e-mail box for the umpteenth time. In his widely-distributed article originally titled “Looking For Someone To Blame? Congress Is Good Place To Start” and then more than twenty years later revised and titled “The 545 People Responsible for America’s Woes,” Reese blames America’s domestic woes on its 100 senators, 435 congressmen, 1 president, and 9 Supreme Court justices.
The self-described traditional conservative with libertarian leanings is currently a registered Democrat. Reese had been a registered Republican until George W. Bush invaded Iraq; then in 2004, he shifted his support to John Kerry.The flighty Reese started out as a Democrat but became a Republican shortly after John F. Kennedy took office. He returned to the Democrat Party once again when the Republicans nominated George H. W. Bush.Reese’s contention that the members of America’s three branches of government are to be blamed for her domestic woes is as well thought out as his party leanings.
