Obama Birth Certificate – Hawaii Revised Law

Preface

This post addresses unanswered legal and factual questions about the Article II, Section 1, Clause 5 of the U.S. Constitution’s requirement that a President be a natural born citizen, and how they relate to President Obama.  It is by no means a complete analysis of the facts and issues.  I welcome any editing suggestions and response posts.   Input is welcome, criticism is expected.

Post

Mr. Obama claims that he was born in Hawaii on August 4, 1961. As his only evidence that he meets the Article II, Section 1, Clause 5 of the U.S. Constitution’s requirement that a President be a natural born citizen, he produced a document called a “Certification of Live Birth,” which he posted on his website under the title: Barack Obama’s Official Birth Certificate.”

At first blush, it is case closed. A closer examination of the facts, however, reveals that Mr. Obama failed to point out on his website that his posted “Official Birth Certificate,” as he called it, is actually a 2007 computer-generated, laser-printed summary document of his 1961 vital record(s) on file with the Hawaii State Department of Health. What we do not know, however, is what 1961 vital record the Certification of Live Birth is summarizing.

In 1961 there were at least six different procedures available to obtain a vital record (birth certificate) that the Certification of Live Birth could be summarizing. The following citations are from the original Hawaii Session Laws books recorded on microform.  All of the citations can be found on one page here.  The other red links below contain the complete history of these laws from before Obama was born to present day:

    The Washington Times ^ | 2005 | Thomas Sowell
Many people today marvel when looking back at the leaders who created the United States of America. Most of the founders of this country had day jobs for years. They were not career politicians. George Washington, who took pride in his self-control, lost his temper completely when someone told him that a decision he was going to make could cost him re-election as President. He blew up at the suggestion that he wanted to be President, rather than serving as a duty when he would rather be back home. Power is such a dangerous thing that ideally it should be…

Obama Begins His Assault On Your Life Savings Terry Jeffrey says the welfare state and your life savings are two cars heading down a one-lane road in opposite directions.  One must yield, or there will be a crash. For Americans who believe in the old-fashioned virtues of hard work, self reliance and respect for private property, the solution is obvious.  The welfare state must yield.  For politicians who believe in the welfare state and redistributing wealth, the solution is equally obvious. Your savings must yield. Barack Obama is of the latter group.  In the new health care proposal he outlined…

You’ve got a long way to go, baby. And don’t you forget it. This oasis of freedom and equality we call the United States? It’s all a mirage, says leftist feminist Jessica Valenti. In fact, “We’re suffering under the mass delusion that women in America have achieved equality.” Well, thanks for the armchair diagnosis, Jessica, but I won’t play a victim character in the live action role playing game you call feminism. And that’s exactly what leftist feminism is: an elaborate fantasy world spun from ginned up scare-tistics and cherry-picked anecdotes. Fox News has just reported that Homeland Security Secretary Janet Napolitano has finally admitted that the Fort Hood, TX massacre was a “Violent Islamic Attack.” On November 5, 2009 American solider Nidal Malik Hasan killed 13 and wounded 30 in the worst mass killing on a Texas military base, or any military base, in U.S. history. (see related story) Even though Hasan was a Muslim whose Islamic faith was central to his identity, and witnesses heard him shouting references to Allah during the brutal attack, the current administration, including Janet Napolitano, has been reluctant to use such descriptive words regarding…

JD Hayworth: Sole AZ Conservative Candidate for US Senate

Recently, I had the distinct pleasure of interviewing former Arizona US Congressman J.D. Hayworth and current Conservative candidate for US Senator from Arizona. Congressman Hayworth is running against the liberal-progressive incumbent Sen. John McCain. The McCain machine is well-oiled and presents a formidable opponent to those who want to preserve the US Republic. However, J.D. believes the momentum for a resuscitation and reinstatement of the principles upon which our country was founded are with him and his campaign. Below is a candid interview of Conservative candidate J.D. Hayworth.

A modest job-creation bill advanced in the U.S. Senate on Monday as the chamber’s newest Republican bucked his party and sided with Democrats on a $15 billion package of tax cuts and highway spending. Republican Scott Brown joined four other Republicans, 55 Democrats and two independents to overcome a procedural hurdle that sets up a final vote later this week.

Are you a free man or property of the State? Samuel Adams, Father of the American Revolution wrote, “If the liberties of America are ever completely ruined…it will in all probability be the consequence of a mistaken notion of prudence which leads men to acquiesce in measures of the most destructive tendency for the sake of present ease.” To acquiesce for present ease means to give up today’s God given liberties for tomorrow’s serfdom. Liberty can be exchanged for bondage. As a liberty loving free man you have the

When President Obama took office, gun rights advocates sounded the alarm, warning that he intended to strip them of their arms and ammunition. And yet the opposite is happening. Mr. Obama has been largely silent on the issue while states are engaged in a new and largely successful push for expanded gun rights, even passing measures that have been rejected in the past. In Virginia, the General Assembly approved a bill last week that allows people to carry concealed weapons in bars and restaurants that serve alcohol, and the House of Delegates voted to repeal a 17-year-old ban on buying…

Why Patriotic Americans Could Resort to “Extremism”

Feb 21, 5:31 PM (ET)
By EILEEN SULLIVAN

WASHINGTON (AP) – Homeland Security Secretary Janet Napolitano (left) says terrorists who are U.S. citizens or live in the country legally and plot against the U.S. are just as big of a concern as international terrorists.

She says that when she started as secretary a year ago, the focus was largely on international terrorists who want to harm U.S. interests. But in the past year, more of the violent extremism that has been seen overseas is showing up in the U.S.

She says officials need to drill down and analyze the factors that make a young person, raised in the U.S., migrate to extremist beliefs and actions.

Napolitano was speaking to governors who are in Washington for their annual conference.

Okay, as a social scientist I am going to help you out, hs head, so listen up

BY “JC”

(for henrymakow.com)

Janet Napolitano wants to know what makes ordinary American citizens become extremists according to her own MIAC type definition (which all of our founding fathers meet, not just some).

When folks like you are in command, complete traitors who care nothing about the US, our Constitution or Bill of Rights, but want only to destroy the US and fold it in to a one world global nazi/stasi style fascist regime, US citizens who understand that you are the “enemy within” become very concerned and angry.

Editor’s note: This is another in a series of monthly “Freedom Index” polls conducted exclusively for WND by the public opinion research and media consulting company Wenzel Strategies.

A new poll reveals Americans believe their freedoms are continuing to slip away under President Obama, with more than 49 percent reporting decreases in their personal freedoms under his leadership this month.

The WND Freedom Index poll from Wenzel Strategies shows even one in 10 Democrats believes there’s been a big decrease in freedoms.

“One month into his second year as president, Barack Obama finds himself saddled with some heavy political baggage,” said Fritz Wenzel, president of the polling company. “Two out of three likely voting respondents to the latest WorldNetDaily/Wenzel Strategies poll think the country is headed in the wrong direction, less than half give him positive job approval ratings, and half think that he is responsible for a reduction in freedom in America.

“And that’s after a month where almost nothing happened in Washington,” he said.

The WND/Wenzel telephone survey was conducted Feb. 18–20 using an automated telephone technology calling a random sampling of listed telephone numbers nationwide. The survey included 30 questions and carries a 95 percent confidence interval. It included 747 likely voters. It carries a margin of error of plus or minus 3.56 percentage points.

(Story continues below)

The Freedom Index, an assessment on Americans’ perspectives on a basketful of liberties, tipped downward for February, coming in at 47.2. It had been 46.3 in December, its lowest point ever, and it moved up only slightly, to 47.5, for January.

Get the prescription for reclaiming America’s heritage of liberty, justice and morality – Joseph Farah’s “Taking America Back,” autographed only at the WND SuperStore.

When the index started last year, it was routinely in the 50-plus range. It is based on a 100-point scale based on answers to 10 questions that sample aspects of freedom including freedom of speech, association, worship and assembly.

If you want to see broken government, consider the fall of the constitutional Roman Republic and the rise of Julius Caesar: “Fortune turned against us and brought confusion to all we did. Greed destroyed honor, honesty and every other virtue, and taught men to be arrogant and cruel, to neglect the gods. Ambition made men false. Rome changed: A government which had once surpassed all others in justice and excellence now became cruel and unbearable.” So said the historian Sallust at the time. But in retrospect, while moral decay surely played its part, the more complete explanation for the fall…

Beck Misread By Colleagues
New Patriot Journal ^ | February 24, 2010 | Walter Scott Hudson

Posted on Wednesday, February 24, 2010 7:46:31 AM by Walter Scott Hudson

Glenn Beck delivered the keynote address at CPAC Saturday, receiving roughly a dozen standing ovations as he utilized his trademark chalkboard to present what he called the progressive “cancer… eating our Constitution.” Beck did not constrain his criticism to the Obama administration or the Democratic party. He called out Republicans as well:

I’m so sick of hearing people say, oh, well the Republicans are going to solve it all. Really? [They are] just progressive-lite. That’s like somebody sticking a screwdriver in your eye and [you] saying, “Stop! Stop!” And somebody else pulls it out and then puts a pin in your eye. I don’t want stuff in my eyes! Stop stabbing in the eyes!

Beck also said:

The Republicans right now are giving us many of those same [progressive] choices – not all of them – but some of them. We have a guy in the Republican Party who says his favorite president is Theodore Roosevelt.

Beck went on to out Roosevelt as a progressive.

Beck compared the condition of the Republican party to that of a drunk at the end of a raucous night of debauchery. Like an alcoholic who hits rock-bottom, the Republicans must admit they have a problem before recovery can occur. This comparison, and the broader accusation of progressivism in the Republican party, has come under attack by conservative colleagues.

Rush Limbaugh said on his radio program Monday:

I would not have said that the only people who can stop Obama, the Republicans, should be excoriated for being just as bad. I don’t know how you could say, after hearing Marco Rubio, that the Republicans are just as bad as [Democrats]. It would never occur to me to say that. I don’t know what the objective would be.

Former Secretary of Education and morning talk show host Bill Bennett was more specific and derisive in a column posted at National Review Online:

To say the GOP and the Democrats are no different, to say the GOP needs to hit a recovery-program-type bottom and hang its head in remorse, is to delay our own country’s recovery from the problems the Democratic left is inflicting. The stakes are too important to go through that kind of exercise, which will ultimately go nowhere anyway — because it’s already happened (Bennett earlier cites examples like Paul Ryan and Michele Bachmann).

The first task of a serious political analyst is to see things as they are. There is a difference between morning and night. There is a difference between drunk and sober. And there is a difference between the Republican and Democratic parties. To ignore these differences, or propagate the myth that they don’t exist, is not only discouraging, it is dangerous.

Both Bennett and Limbaugh misread Beck’s point. Beck clearly articulated the difference between the Democrats and the Republicans. His analysis suggests a difference insufficient to satisfy principled conservatives. Beck is calling for more than rhetoric, more than speeches from individual politicians. Beck is looking for broad and consistent action. He is looking for Republicans at large to embrace principle over politics.

Scott Brown, the celebrated new senator from Massachusetts, just voted for Obama’s “jobs bill,” which has been widely analyzed as yet another stimulus package. In Minnesota, 15 Republican state senators recently went along with the Democratic majority to pass a $1.2 billion bonding bill which includes funding for volleyball courts and gorilla cages among other pork barrel projects. The actions of the GOP at large do not match the rhetoric of figures like Rubio or Bachmann. In some cases, like Brown’s, individual Republicans literally say one thing and do another. This is what Beck speaks to. This is the behavior for which he demands repentance.

Presumably, Bennett regards Beck’s message as “dangerous” because the electoral failure of Republicans means the electoral success of Democrats. Yet, this is precisely Beck’s point; it does not matter if the GOP emerges from 2010 victorious if they merely “suck less than the other guys.” Republicans need to become a true alternative to progressives. It is not sufficient to be Republican.

Curiously, Bennett cites the Tea Party movement as evidence Republicans have seen the error of their ways, as if the movement emerged from the party. As recent posts at the New Patriot Journal declare and demonstrate, the Tea Party movement is not a Republican proxy. It contains Republicans. It is not of or about Republicans. If anything, the movement has emerged in response to Republican hypocrisy as much as any Democratic policy. The movement is not about party politics. It is about principled governance and citizen activism.

This concept of principle over party seems to genuinely confuse Limbaugh. When he says he does not know what the objective of excoriating Republicans is, he demonstrates a vision obscured by a partisan lens. If you do not like Obama, Limbaugh’s paradigm demands you love Republicans. The Tea Party, like Beck, rejects that false dichotomy. Contrary to Bennett’s perception, the true danger in 2010 lies in trusting Republicans without holding them to account. Voters cannot find comfort in a slower march off the same progressive cliff.

What are we to make of the Republican Party’s future now that libertarian Rep. Ron Paul won the presidential straw poll at the well-attended Conservative Political Action Conference last week? Is the GOP about to transform into the party of the gold standard? Let’s, for a moment, forget Paul (and how I wish this could be a permanent condition, considering the congressman is neither a serious politician nor — and I can’t stress this enough — a serious thinker). Libertarianism offers conservatives — many of them new to political activism — an earnest ideological alternative to the process-heavy politics that…

Negative Impact of Policies Based on False IPCC Reports

The Appeal of Islam – Islamism is a Reaction to Multiculturalism

imageTo understand the danger posed by Islam, one must first understand its Islam. And I don’t mean its spiritual appeal, because Islam is not a particularly spiritual belief system. It is not really much of a belief system at all, so much as it is a tool of social organization. Because Islam is far less concerned with what people believe, than with what they do. It is not so much of a religion, as a means of ordering behavior within a society along particular lines.

Fundamentally, despite his Ivy League pedigree, it seems Obama sprouted to maturity without any of the normal struggles, ordeals, obstacles or setbacks against progress that normally aid in the development of character, depth, maturity and wisdom.

The Generation Zero Documentary—first previewed at the Tea Party Convention and CPAC—on Hannity last night confirmed that liberalism and the Baby Boomer generation were indeed the cause of the US financial meltdown, not to mention the worst recession since the Depression in the US. The brainchild of Steve Bannon and Dave Bossie, Generation Zero wasn’t screened in its entirety on Hannity, but was broken down into several segments which were then analyzed in specific detail by Hannity and its creators. A pejorative reference to the Baby Boomer Generation that came of age in the drug-fueled and “If it feels good,…

We’ve known from the start that there were warning signs of Major Nidal Malik Hasan’s Islamic fanaticism well before the Fort Hood shootings, signs we suspected were ignored due to political correctness. But the other night, Sean Hannity called attention to a recent Boston Globe report confirming our worst fears. The report claims that Army officials knew Hasan was a radical, but “did not act in part because they valued the rare diversity of having a Muslim psychiatrist.” Examples of Hasan’s radical behavior have previously been disclosed in press accounts based on interviews with unnamed Army officials […] But the…

Something very good al ready has happened as a result of President Obama’s strange entry into the health-care sweepstakes. Think of it as the death of a myth. The myth was that Obama was an innocent bystander caught between evil forces. As supporters describe it, the president was trapped on one side by tone-deaf Democrats and on the other by obstructionist Republicans. If only the leaders of the two parties were as smart and honest as Obama, Washington would be a marvel of efficiency and progress. As Exhibit A, Obama dead-enders promised the sun of health care would shine on…

This was written by retired Admiral and U.S. Sen. Jeremiah Denton to an audience at the National Marine Corps Museum Feb. 13th. We are in a struggle for our very survival in America. This book (autobiography, “When Hell Was in Session”) presents my ideas of how we can win that struggle. Although the plan is far from complete, I have already concluded that, though we are presently in a bad way, we can indeed come from behind and will win this cultural war. This belief is based partly on the truism that he who is most hungry for victory has…

Cell Phones Have ‘Off’ Buttons For A Reason
A couple of weeks ago I heard a strange noise in the middle of an evening worship service at my church. Some in attendance, including yours truly, looked around to see what it was and where it was coming from while the pastor continued to speak. Eventually, we all realized it was just another ringing cell phone. I don’t know if the pastor was annoyed by the interruption, but I was………

Neil Cavuto is RIGHT NOW the FACE of the CRANKY AMERICAN who is VERY DEEPLY CONCERNED about their country. If Neil is anything, he is consistent. He hated TARP and railed against it. He hated the bailout, and railed against that. And as the spending piled up, he pushed back with, “It is, it’s taxpayer’s money.” Now we can add this one to our growing Cavuto file.

Ode to Orly Taitz

by the Freeper, parsifal

Mississippio Countrio

It was late February, and the year it was twenty ten.

I was surfing on line, slurping down a little lime and gin.

Well I was scrolling all around when the words flashed upon the screen.

And it nearly laid me out, now let me tell you what I seen.

Well it was something out of Outer Limits, something off of the Deep End.

Today, Orly Taitz, the Birther Queen, went seeking help at the U.N.

Well my glasses fogged over and I nearly had a heart attack

I even sent that gal some money and I wonder “Can I get it back?”.

I backed her up when she lied all about that African Bee Cee.

I even backed up her the second time, “Man, what is wrong with me?”

Guess she was playing some game that I just couldn’t comprehend….

And now you tell me, Orly Taitz, appealed it all up to the U.N.

When the case got dismissed down in Florida, should have been a clue.

Then, California, man you know it’s standing now at O and 2.

Then that Judge done went and handed her a twenty thousand dollar fine.

I guess I should have seen it then, you know the case was kinda asinine.

But I hung in there while she was sleeping with her boy friend.

And now Orly Taitz is begging for protection, “Pretty Please! U.N.”

Well looking back on it all, I guess she kind of took me for a ride.

Using all that legal talk, made it seem somehow so bona fide.

And with all of the problems that she had, it should be no surprise.

Certificate of Live Birth, man I wish I had believed my eyes.

And the birth announcements too, I wish that I could kick my own rear end!

And now you tell me Orly Taitz is hauling *ss to hide at the U.N.

— parsy, who says Enjoy!

George Casey told a Senate committee Tuesday he doesn’t know how a repeal of the military’s “don’t ask don’t tell” policy will impact troops’ “readiness and effectiveness.” Feb. 23, 2010 WASHINGTON – The Army’s top uniformed officer said Tuesday that he has “serious concerns” about overturning a 17-year policy that bans gays from serving openly in the military and supports a yearlong study into the matter before any changes are made. Obama Begins His Assault on Your Life Savings

Obama Begins His Assault on Your Life Savings
Townhall.com ^

Posted on Wednesday, February 24, 2010 1:41:42 AM by TruthHound

The welfare state and your life savings are two cars heading down a one-lane road in opposite directions.

In the new health care proposal he outlined this week, he suggested a series of unprecedented tax increases that would extend the greedy hands of government into the life savings of hard-working Americans.

These new taxes would essentially construct a new fiscal pipeline capable of carrying money out of the savings of private citizens and dumping it into government coffers specifically for subsidizing Medicare under the new health care system Obama envisions. The White House summary of Obama’s proposal presents this would-be pipeline as a facilitator of economic justice.
