America, we\’ve got some bad news: Our Constitution isn\’t going to make it. It\’s had 224 years of commendable, often glorious service, but there\’s a time for everything, and the government shutdown and permanent-crisis governance signal that it\’s time to think about moving on. \”No society can make a perpetual constitution,\” Thomas Jefferson wrote to James Madison in 1789, the year ours took effect. \”

The earth belongs always to the living generation and not to the dead.… Every constitution, then, and every law, naturally expires at the end of 19 years.\” By that calculation, we\’re more than two centuries behind schedule for a long, hard look at our most sacred of cows.

Today, 17 September 2009, is Constitution Day. There will be paeans, abundant commentary and church-like observances of the glories of this document in making us the most blessed nation on planet earth. This essay suggests a contrarian thesis.

The Constitution is an enabling document for big government. Much like the Wizard of Oz, the man behind the curtain is a fraud. In this case, for all the sanctimonious handwringing and the obsequious idolatry of the parchment, it sealed the fate of our liberties and freedoms and has operated for more than 200 years as a cover for massive expansion of the tools and infrastructure of statist expansion and oppression.

Among the many intellectual travels I have undertaken, this is one of the most heart-breaking I have ventured on. I want to acknowledge the compass-bearers who sent me on this journey: Kenneth W. Royce (aka Boston T. Party) and his seminal book,

The Hologram of Liberty and Kevin Gutzman’s Politically Incorrect Guide to the Constitution. For most of the political spectrum in America, the document represents their interpretation of how to make this mortal coil paradise. Even in libertarian circles, it is taken as an article of faith the Constitution is a brilliant mechanism to enlarge liberty and keep government at bay. That is a lie.

Newspaper reporters were excluded.These men had been authorized by Congress and by several state legislatures only to revise the Articles of Confederation 1781, but not replace them.

Knowing full well that they planned to replace the Articles with a new form of government, the leaders of the Convention nevertheless agreed to the terms laid down by the state legislatures, and then went off to Philadelphia to begin the first stage of a political revolution.

Rather, the Articles proved themselves to be a perfectly viable structure for a free society, encouraging trade and prosperity and adherence to the highest ideals of 1776.

The driving forces for the creation of the central government with the Constitution involved economic imbalances and debts leftover from the war with Britain.

The federalists, ideologically attached to protectionist and nationalist theories, exploited both real and false fears in the hope of resolving these imbalances, but they ended up by recreating what the founding generation had struggled so hard to overthrow ten years earlier.

Of course, the truth of many such actions was effectively covered up until historical accuracy was revealed through the Internet Reformation. This is why the history books and public school texts teach only the authorized propaganda version.

The first was the Whiskey Rebellion in 1791 in which armed resistance by citizens against a new whiskey tax took place in opposition to Treasury secretary Alexander Hamilton’s federalist program to increase central government power and revenue. George Washington and an army were used to successfully quell the rebellion.
